    1. CORD MEMBERSHIP SCHEME – TERMS AND CONDITIONS

      CORD MEMBERSHIP SCHEME – TERMS AND CONDITIONS

      The CORD Membership Scheme is operated by “Gastronomist Limited”, “CORD” or “we”).

      These Terms and Conditions apply to your participation in, and use of the features on offer by the CORD Membership Scheme at 85 Fleet Street, London EC4Y 1AE (“Location”) at which CORD provides catering services to its clients (which, for the purposes of these terms and conditions, is the “Provider”).

      The key features of the CORD Membership Scheme are as follows:

      (a)    At CORD, you may be able to use a CORD Membership Card (the “Card”) and/or CORD Click & collect App (the “App”) for the collection and redemption of loyalty points, and to potentially benefit from promotional vouchers (“Vouchers”) at the Location. See sections 1 and 3 below for the relevant terms and conditions.

      Use of the Card, the App or other features of the CORD Membership Scheme will constitute acceptance of these Terms and Conditions, which together with our Privacy Policy and Website Terms and Conditions govern our relationship with you in relation to the CORD Membership Scheme.

      You must reside in the UK and be aged 16 or over to participate in the CORD Membership Scheme and access any of the features described above.

      1.     GETTING A CORD MEMBERSHIP CARD OR APP

      As a customer of the “Provider” or another person approved by the “Provider”, you may hold a Card or may download the App which enables you to participate in the CORD Membership Scheme whereby you will collect loyalty points on purchases made at the Location, and potentially also benefit from Vouchers.

      CORD may be enabled to participate in the CORD Membership Scheme via the App alone; or may be enabled for the use of Cards as well.

      The App is free of charge and can be downloaded from the CORD Membership Scheme website at  https://apps.apple.com/gb/app/cord-by-le-cordon-bleu/id1620340324 or if available, via a QR code that may be found on marketing material within CORD.  Certain mobile devices may not support the App, in which case you will not be able to use it.  You will need to register your mobile device against your Account before the App can be used. You can use the App to create a new Account or you can register the App against your existing Account. If you change mobile devices, you will need to register the new device on the Website before using the App in order to access your information.  

      If CORD Cafe is enabled to use Cards for participation in the CORD Membership Scheme, this may be either your Employer’s ID Card or a general scheme card.

       

      General Scheme Cards: If CORD enables The CORD Membership Scheme via general scheme cards, you can pick one up free of charge from the Location. General scheme cards do not need to be registered prior to use, but any points accrued prior to registration cannot be redeemed until the Card is registered.

       

      Your Card is not a credit or charge card and remains the property of Gastronomist Limited or the “Provider” (as agreed between those parties).  The Card must not be sold or traded in any way. You must not loan your Card to any other person, it is for your exclusive use.

      You may only use the Card and/or the App at your “Provider’s” Location, and not at other sites associated with the “Provider”.  

      You may cancel your Card and/or delete your App at any time but if you do so, you may forfeit the right to any points that have accumulated on your Account that have not been used and may forfeit any balance of monies on the Account where the Cashless System applies (see below regarding refunds.

      If your smartphone with the App is lost or stolen or if your Card is lost or stolen, you must notify us of this via the Website.  Gastronomist Limited will not be liable for any resulting loss of points, vouchers or monies.

      We reserve the right to reject any Cards that become unreadable and also to refuse to redeem any points or Vouchers which have been acquired or accept payment via a Cashless System where the Card has, or the balance of points have been acquired, or is suspected to have been acquired, via theft, fraud or any other means that are not in accordance with our Terms and Conditions. If your Card is lost or stolen, CORD will not be liable for any resulting loss of monies.

      2.      CORD CLICK & COLLECT

      The CORD Click and Collect service allows customers to pre-order and pay for selected food and drink items featuring on the takeaway menu, via the Website, for same day collection from CORD Café.

      All items offered on our Website are subject to availability and might change without notice. We will not be liable to you if we are unable to provide any item(s) for any reason and if any item is unavailable or out of stock, you may be prevented from purchasing the item. If an order is finalised and payment is processed but the item becomes unavailable, we will notify you of this as soon as possible and issue a full refund of the unavailable item(s) to you on to the cared to make the purchase.

      During the order process you will be able to view the order in your basket prior to submitting payment. You will be able to see the items that you have ordered and the total price for the order. Once an order is placed, an order confirmation will be sent to the email address provided.

      CORD reserves the right at any time without notice or liability to:
      - Decline a new customer at any time and at our sole discretion;
      - Terminate your access at any time and at our sole discretion;
      - Change or withdraw the Website and / or the CORD Click and Collect service or any part of it at any time with or without any notice at our sole discretion;
      - Cancel orders due to unforeseeable circumstances or shortages;
      - Block your use of the Website and / or the CORD Click and Collect Service at any time if you do not comply with these terms and conditions. Your statutory rights are not affected;
      - Report any suspected abuse of the Website and / or the CORD Click and Collect service to the police and / or to instruct a debt recovery agent to seek payment from you on CORD behalf.

      Price and payment:
      We require immediate payment when you order from our Website and all items purchased must be paid for in full at the time that the order is placed.

      All of the prices for our items will be shown in pounds sterling and are inclusive of VAT. The price of the items are as quoted on our Website at the time that you use it and will only apply to the items listed on the Website.

      When you place an order, payment will be taken for an amount of money equal to the value of the order against the card that you have used for payment when you place your order with us by clicking the “Confirm Payment” button at the end of the checkout process

      From time to time, we may not be able to accept an order or we may cancel an order. This may be due to circumstances beyond our control and if we cannot accept your order, we will inform you of this by email as soon as we can and we will not charge you for the order or a refund of the total amount will be issued to the card provided at the time of purchase.

      Product information
      The product information contained on our Website has been published in good faith and we will do our best to ensure that it is accurate. However, occasionally, it may be incorrect, incomplete or out of date due to human error or circumstances beyond our control. Where information is incorrect due to human error or circumstances beyond our control, we reserve the right not to accept your order for the affected products, or if your order has already been accepted, not to supply the affected products to you. You will not be charged for these products.

      The images of products on our Website are for illustrative purposes only. Although we have made every effort to display colours and appearances of products accurately, we cannot guarantee that a computer, tablet or mobile device screen will accurately reflect actual products delivered as devices may vary slightly.

      Collection of your order
      Items ordered from the App / Website may only be collected from CORD Café and cannot be delivered to any other location.

      You must not consume an item that is damaged or does not match the order that you placed on the App / Website. If you use such items, you will be deemed to have accepted them and you may be unable to return them because they are different to your order or are damaged.

      The order will be collected from CORD Café counter. Upon arrival at the collection point, you must make yourself known to a member of staff and provide the order number stated in the order confirmation email. A CORD member of staff will use this order number to identify your order.

      We reserve the right to dispose of your order if it is not collected within fifteen (15) minutes of the selected or allotted collection time and you will not receive a refund or replacement items.

      3.     YOUR LOYALTY POINTS

      If you choose to use a combination of the Card and the App, points collected will be accrued to one Account if the Card and App are correctly registered to that same Account.

      Loyalty points can be accrued and redeemed against certain purchases made at the Location.  We reserve the right to restrict the products against which loyalty points may be redeemed at our discretion (and as may be advised to us by the Employer).  Please ask a CORD employee at the Location for more information.

      Points cannot be accrued or redeemed against any functions.

      The points will be earned at the time of purchase, provided the Card or the App is presented at the point of sale.  If the loyalty terminal is not working and/or if our systems are down due to an event beyond our control, you should still be able to accrue points.  However, we will not be responsible for any loss suffered by you in such circumstances particularly if you are unable (in these circumstances) to collect or redeem points against your current transaction.  If you forget your Card or the App we cannot add points to your Account at a later date.

      Points will accrue on the entire transaction (provided no excluded items are being purchased).  Points can only be collected against purchases where a till and card reader is present. An Account can hold an unlimited number of loyalty points.

      You can check how many points you have and also redeem points at the Location.  You can also check the number of loyalty points you have collected on-line by visiting the CORD Membership Scheme website.

      You will earn a specific number of loyalty points for each complete pound spent as may be advised to you at the Location.  The number of points per pound spent is subject to change.

      You will only be able to redeem your loyalty points against purchases made at the Location, each point has a redemption value of 1 pence. The number of points used will be deducted from your Account.

      When using your points to make a part of full payment, all available points must be redeemed against the purchase.

      If you have a discrepancy regarding the number of points on your Account, we may require you to provide receipts as proof of purchase to back up any claim.  If the evidence is satisfactory (to us), we will change the points allocated to the applicable Account to reflect the correct position.

      We will not exchange points for cash and reserve the right to remove from your Account any points that have not been redeemed for over 12 months.

      4.     GENERAL

      Gastronomist Limited can cancel or withdraw the Card, the App and/or the Scheme for any reason at any time. In such circumstances, we will endeavour to provide you with as much written notice as possible. 

      We may also change these Terms and Conditions as is necessary by updating them on our Website.  You should therefore check the Website from time to time to review these Terms and Conditions, because they are binding on you.

      We shall not be responsible or held liable for any default or event arising directly or indirectly from any cause or event beyond our control.  To the extent permitted by law, we also will not be liable for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the App, Cards or CORD Membership Scheme, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the App, this Website or otherwise connected with the CORD Membership Scheme.  To the extent that we may be liable, our aggregate liability to you shall not exceed the amount directly paid by you to participate in the CORD Membership Scheme.

      If any provision of these Terms and Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms and Conditions, which shall remain in full force and effect.

      We may transfer the benefits of these Terms and Conditions to a company in the same group as Gastronomist Limited and if we do so, your rights will not be affected in any way.

      These Terms and Conditions are governed by English law and subject to the non-exclusive jurisdiction of the English Courts.
